The Emergen-C "Quest for the Ultimate Ride" Sweepstakes ("Sweepstakes") will begin at 12:00 AM Eastern Time (ET) on December 15, 2008 ("Sweepstakes Start Date"), and end at 11:59 PM EDT on March 28, 2009 ("Sweepstakes Period"). Sweepstakes is sponsored by Alacer Corp., 80 Icon Foothill Ranch, California 92610 (the "Sponsor") who are solely responsible for all aspects of this sweepstakes.
Eligibility: Sweepstakes is open to all legal residents of the 48 contiguous United States and D.C. (excludes Hawaii and Alaska), 18 years of age or older, as of "Sweepstakes Start Date". Employees, officers and directors of the Sponsor, their affiliates, subsidiaries, agents, member magazines, advertising and promotion agencies, (collectively including Sponsor, "Sweepstakes Entities") their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited by law, regulation or ordinance.
Two Ways to Enter: 1) Entrants must complete an online Sweepstakes registration form available at www.go211.com/emergenc All designated information must be submitted to be eligible to enter and win. All on-line entries must be received by 11:59pm ET on March 28, 2009. 2) Participants may enter by completing an official Sweepstakes entry form at any of the following events: Copper Mountain, Colorado (1/2/09-1/4/09), Northstar-at-Tahoe, California (1/9/09-1/11/09), Bear Mountain, California (1/16/09-1/18/09), Keystone, Colorado (1/23/09-1/25/09), The Summit at Snoqualmie, Washington (1/30/09-2/1/09), Park City Mountain Resort, Utah (2/6/09-2/8/09), Spirit Mountain, Minnesota 2/20/09-2/22/09), Mountain Creek, New Jersey (2/27/09-3/1/09. Place the fully completed entry form in the designated box at the aforementioned events.
Limit one entry per person and/or per e-mail address regardless of the method of entry. All entries must be received by the promotion end-date of March 1, 2009. Incomplete entries or those containing incorrect information will be voided. The use of any automated launching or entry software or other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited and all such entries are void. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes. All entries become the property of the Sponsor and will not be acknowledged or returned.
Internet Limitations of Liability: If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Prizes: There will be One (1) Grand Prize winner, and fifteen (15) First Prize weekly winners. The Grand Prize winner will receive a 4 day/3 night trip for two (2) to the 2009 Snowboarding U.S. Open to be held in Stratton, Vermont on March 19 through 22, 2009. The trip includes round-trip airfare, hotel accommodations, Event and competition viewing and party access, Private snowmobile rides for competition viewing on mountain, On-mountain lift tickets for two daily, 15 minute Helicopter ride (weather permitting), Burton outerwear for two (gear may include helmet, goggles, and board depending on availability- selections will be from a catalog provided), one (1) year of Emergen-C product for two and a $1000 cash stipend. The Approximate Retail Value of the Grand Prize is $3,932. The winner will receive air transportation for two (2) people from the major commercial airport nearest the winner's home. Stopovers are not permitted on flight voucher issued and, if a stopover occurs, the prize will terminate at the stopover point and full fare will be charged for the remaining segments of the flight. The Sponsor (or Sponsor designee), in its sole discretion, will determine transportation and lodging accommodations. The travel, event tickets and accommodations can not exceed the maximum allowable prize amount of $3,932. Travel, event tickets and accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor's sole discretion. Winner and his/her guest will be solely responsible for all other expenses not specifically set forth herein including but not limited to taxes, meals, gratuities, souvenirs, telephone, in-room services and any other incidentals. Travel and accommodations subject to availability; and certain restrictions may apply. Winner and travel companion must execute liability/publicity releases prior to issuance of travel documents. The Prize awarded consisting of products/services for two people require that you and your companion redeem the prize together. The Grand Prize will be deemed awarded upon the winner's receipt of event tickets (or voucher) and travel/lodging confirmation. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. If the event portion of prize is cancelled or rescheduled for any reason, Sponsor will not be responsible for awarding that portion of the prize, but the remainder of the prize package will be awarded. The trip must be completed by March 22, 2009 or prize will be forfeited. Each First Prize winner will receive one (1) Emergen-C Shred Ready Kit. Each Kit includes: Burton Snowboard Prep Kit, Emergen-C branded water bottle, and 4 month supply of Emergen-C (4 retail boxes). The Approximate value of each kit is $70.
By accepting any of the aforementioned prizes, each prize winner agrees to release Sweepstakes Entities from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity. All local, state and federal taxes are the sole responsibility of winner. Prizes are not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value.
Drawing and Notification: The Grand Prize winner will be selected, from among all eligible entries received, in a random drawing conducted on or about March 4, 2009, by American Sweepstakes & Promotion Co. ("the Administrator") an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. The weekly First Prize drawings will be conducted on or about: 12/22, 12/29, 1/5, 1/12, 1/19, 1/26, 2/2, 2/9, 2/16, 2/23, 3/2, 3/9, 3/16, 3/23, 3/30. Odds of winning will depend on the total number of eligible entries received. The potential Grand Prize winner will be notified by phone and mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor's choice. The First prize winners will be notified by mail.
Prize Conditions: Winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 5 days of written notification. Travel companion must also execute and return a travel release. The travel Companion must be 18 years of age or older as of March 18, 2009. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor's sole discretion, an alternate winner may be selected for the prize at issue. All taxes, if applicable, are the sole responsibility of the winner.
Release: By participating in this Sweepstakes, all entrants and prize winners release, discharge, and hold harmless Alacer Corp., and its affiliates and agents, including, without limitation, its respective officers, directors, shareholders and employees (collectively "Released Parties") from and against any and all liability or claims for any injury, loss, illness, litigation or damages arising out of their participation in the Sweepstakes and/or the acceptance, use, misuse, non-use or possession of the prize. Released Parties are not responsible for printing or typographic errors in any Sweepstakes or related material or for stolen, lost, late, misdirected, damaged, incomplete, postage due, and/or illegible entries or mail.. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be resolved by applying the laws of California and that it shall be resolved by and within the courts of that state.
General Conditions: All federal, state and local laws apply. Alacer Corp. is the final interpreter of these Official Rules. The decisions of Alacer Corp. are final in all matters relating to the Official Rules. By participating in this Sweepstakes you agree to the use of your name, photograph, likeness, statements, biographical information, voice, address (city and state), and/or identity in all forms of media, advertising, publicity and promotional purposes, in perpetuity, without notice or further compensation, unless prohibited by law. You will also be subject to Alacer Corp.'s Privacy Policy and opt-out provisions. Any person attempting to defraud or in any way tamper with the sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law.
